Traffic Ticket Help

How a Traffic Ticket Affects Your California Record

Not every traffic ticket damages your record the same way. Whether a conviction shows up as one point, two points, or no points depends on the code section on the citation — and that determines insurance impact and your ability to use traffic school.

Not legal advice. This is general education. Your local county and court set the exact forms and procedures. If you have an active warrant, a serious charge, or a CDL at risk, talk to a qualified attorney promptly.

The point system

The DMV assigns points to most moving convictions under Vehicle Code § 12810:

  • One point: most moving violations — speeding, most stop sign and red light infractions, cell phone.
  • Two points: more serious convictions, including reckless driving and DUI.
  • Zero points / no points: parking violations, most equipment and "fix-it" violations, and some correctable offenses.

Points normally stay on your record for 36 months from the conviction date (longer for serious offenses).

What points actually do

  • Insurance: insurers pull your record; points and tickets raise premiums.
  • Negligent-operator threshold: too many points in a rolling window can make you a negligent operator and trigger a DMV review or suspension (see DMV suspension).
  • Employment: for commercial drivers, points can affect a CDL record (see CDL violations).

Vehicle-code first offense and masking

If it is a first-time eligible moving violation, the court may offer traffic school that hides the point from your public record. After completion, the conviction remains on file but the point is masked — so insurers and most employers pulling a standard record won't see it. You can generally use court-approved traffic school once every 18 months for a different ticket.

Bottom line

Read the code section on your citation: that tells you the point value and whether traffic school is even an option. Points linger for three years, so a good resolution now protects your record for years.
